Uninsured Motorist

UNINSURED MOTORIST

Uninsured motorist accidents result when the responsible party or the owner of the vehicle that caused the accident has no automobile insurance but the injured party does have insurance.

Uninsured (UM) and Underinsured (UIM) motorist coverage is a type of bodily injury insurance designated to compensate the injured non responsible party for damage inflicted by an uninsured or underinsured motor vehicle and its driver/owner.

If you have uninsured motorist (UM) coverage, it means that your insurance company will cover you, the insureds members of your household and your passengers for any injuries, damages or death caused by another driver if you are involved in an accident where the other driver is at fault but he/she or the owner of the vehicle, if different from the driver, has no insurance. Uninsured motorist (UM) coverage also applies and will pay you for your injuries and damages if you are insured by a hit and run driver as well. Your UM coverage will cover your claim for medical expenses, lost earnings and pain and suffering caused by injuries up to your UM coverage limit on your policy.

Underinsured motorist (UIM) bodily injury coverage is often incorporated into your uninsured motorist coverage. If you are involved in a motor vehicle accident where you suffered damages for medical expenses, loss of earnings and pain and suffering in an amount greater than the coverage purchased by the person at fault, your underinsured motorist coverage may contribute more money to your claim if your policy limits on the underinsured motorist portion of your automobile policy are higher than that of the at fault parties policy limits
At the Law Offices of Joseph C. Durante, Jr., we determine at the outset of your claim for personal injuries not only the coverage the responsible party has for any given automobile accident but whether or not the injured party has uninsured/underinsured motorist coverage as well.
